Drones are strictly banned over marine mammals by the Department of Wildlife Conservation. The high-pitched buzzing severely distresses the whales. It is an animal safety issue. Ethical boat captains will refuse to let you launch it, and the Coast Guard patrols the area. Bring a heavy telephoto lens (300mm+) instead.

Also, landing a drone on a rocking boat in the ocean swell is a great way to lose your drone in the sea.
